The Hemp Farmacy and the Wilmington Hemp Industry

The Hemp Farmacy, the consumer-facing brand of Hempleton, is headquartered in Wilmington and was founded by Justin Hamilton in 2016. The company runs retail locations in Wilmington and elsewhere in NC and is one of the longest-running dedicated hemp retailers in the state. Hempleton’s presence makes Wilmington a coastal anchor of NC’s hemp economy alongside Raleigh, Charlotte, Durham, and Asheville.

NC has roughly 858 USDA-licensed hemp growers and approximately 144 hemp/CBD retail outlets statewide, with Wilmington one of the densest coastal concentrations. Products typically span CBD, Delta-8, Delta-9 hemp-derived edibles and beverages, THCA flower, and HHC. Operation Vapor Trail and the New Hanover Connection

Operation Vapor Trail — the multi-agency raid executed on April 3, 2024 — was the highest-profile NC hemp enforcement action of the modern era. Federal partners (DEA, NCIS) joined Onslow County, New Hanover County, the Jacksonville Police Department, the Hope Mills Police Department, and the Wilmington Police Department in raiding 71 vape and tobacco shops across six NC counties. Officers seized 104.29 lb of products characterized as Schedule I, 3,006 lb of products characterized as THC/marijuana, and approximately $855,577 in cash; 17 arrests were reported.

A December 6, 2024 federal civil-rights lawsuitSaleh et al. v. Onslow County Sheriff Chris Thomas and Lt. Jay Floyd (EDNC) — alleges unlawful search and seizure and discriminatory targeting of Middle Eastern-owned shops. Counsel Abraham Rubert-Schewel (Tin Fulton Walker & Owen) alleges the sheriff’s office used gas chromatography techniques that decarboxylate THCA into delta-9 THC and thereby distort test results. Hemp Retail Is Not Risk-Free

Wilmington PD participated in Operation Vapor Trail. Hemp products that test as ≤0.3% delta-9 THC under industry-standard chromatography may produce different results under law-enforcement testing protocols, exposing retailers and possibly customers to enforcement risk.

Beach Tourism and the Practical Cannabis Question

Wrightsville Beach, Carolina Beach, Kure Beach, and Topsail Beach drive Wilmington’s summer economy. Each beach has its own town police department, but all operate under NC state cannabis law. There is no medical and no recreational program in NC. Visitors should not assume coastal-tourism leniency — possession penalties under N.C.G.S. § 90-95(d)(4) apply at the boardwalk just as in downtown Wilmington.

Wilmington International Airport (ILM) is federal jurisdiction. As elsewhere, do not fly with cannabis or intoxicating hemp products through ILM.

UNCW, the Port, and the Cape Fear River

UNC Wilmington has roughly 18,000 students. Like all UNC System campuses, it is a drug-free workplace, and cannabis use on campus violates university policy independent of NC state law. The Port of Wilmington is one of NC’s major shipping facilities. The Cape Fear Memorial Bridge marks the western edge of downtown.

The Federal Hemp Cliff and Wilmington

Federal P.L. 119-37 takes effect November 12, 2026. The law redefines hemp by total THC (including THCA) with a ceiling of 0.4 mg total THC per finished consumer container, and excludes synthetically converted cannabinoids from the hemp definition. Industry analyses estimate roughly 95% of current NC intoxicating hemp products will be removed from federal-legal sale on that date, absent congressional delay or modification. Cannabis Is Illegal in NC

There is no medical and no recreational program. Possession of 0.5 oz or less is a Class 3 misdemeanor; over 0.5 oz can mean jail. Beach-town police follow state law.

Hemp Retail Is Real

The Hemp Farmacy and other Wilmington hemp retailers operate under N.C.G.S. § 90-87(13a). Products must meet the ≤0.3% delta-9 THC dry-weight standard.

No Cannabis on Federal Land

Cape Fear National Seashore-area federal land, military installations, and the Port (federal authority overlay) all remain federal jurisdiction.

ILM Is Federal Jurisdiction
